Terms of Use

These Terms of Use (“Terms”) govern your access to and use of www.tnmarinas.com and any related pages, services, or content (collectively, the “Website”) operated by the Kentucky Marina Association (KMA) and the Tennessee Marina Association (TMA) (together, the “Associations,” “we,” “us,” or “our”). By accessing or using the Website, you agree to these Terms.


If you do not agree to these Terms, do not use the Website.


1) Who may use the Website

Use of the Website is personal to you and not transferable. You must comply with all applicable laws and these Terms when using the Website.


2) Accounts & accuracy of information

If the Website allows account creation or event registration, you agree to provide accurate, current, and complete information and to keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.


3) Payments, refunds, and cancellations

Payment policy. Fees for events, sponsorships, memberships, or merchandise (as applicable) are due at checkout.


Refunds for events. All sales are final. Refund requests must be received at least 5 days prior to the event in writing (email is acceptable). In our discretion, we may issue a credit for use toward a future Association event.


Membership dues & sponsorships. Unless otherwise stated in a written agreement, membership dues and sponsorship payments are non-refundable once processed.


Chargebacks. You agree not to initiate chargebacks without first contacting us to resolve any issue. We reserve the right to contest chargebacks with your payment provider.


4) Shipping & delivery (for merchandise)

If the Website offers merchandise:


Processing & shipping. Orders generally ship within 7–10 business days via USPS or UPS. Shipping costs and taxes (if any) are shown at checkout.

Delivery issues. Risk of loss passes to you upon our delivery to the carrier. Report missing or damaged items within 7 days of delivery.


Returns. Returns are accepted only for defective items reported within 7 days; contact edirector@tennesseemarinas.com for authorization.


5) PCI & payment security

Online payments are processed by secure third-party payment processors. We do not store full payment card numbers on our servers. You agree to comply with any additional terms required by our payment processors when making a payment.


6) Intellectual property

Ownership. All materials on the Website—text, graphics, logos, images, videos, and other content—are owned by or licensed to KMA and TMA and are protected by U.S. and international intellectual-property laws.


Limited license. You may view the Website for your personal, non-commercial use. You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or exploit any part of the Website without our prior written consent.


Trademarks. Kentucky Marina Association, Tennessee Marina Association, and associated logos are trademarks/service marks of the respective Associations. You may not use our marks without prior written permission.


7) User content & acceptable use

If you submit content (e.g., registrations, comments, or directory listings), you represent that you have the rights to do so and that your content is accurate and lawful. You agree not to:


(a) violate any law;
(b) infringe others’ rights;
(c) upload malware or interfere with the Website;
(d) attempt to gain unauthorized access; or
(e) use the Website for commercial solicitation not authorized by the Associations.


We may remove content or restrict access at our discretion.


8) Third-party links

The Website may link to third-party websites for your convenience. We do not control and are not responsible for third-party sites or content, and inclusion of a link does not imply endorsement.


9) No warranties

THE WEBSITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, THE ASSOCIATIONS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.


10) Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE ASSOCIATIONS AND THEIR OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE WEBSITE OR ANY CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

WHERE LIABILITY CANNOT BE EXCLUDED, IT IS LIMITED TO THE AMOUNT YOU PAID (IF ANY) FOR THE APPLICABLE TRANSACTION DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.


11) Indemnification

You agree to indemnify, defend, and hold harmless the Associations and their officers, directors, members, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Website or your violation of these Terms.


12) Governing law & venue

These Terms and your use of the Website are governed by the laws of the Commonwealth of Kentucky and the State of Tennessee, without regard to conflict-of-laws rules.


Exclusive venue for any action arising out of these Terms shall lie in the state or federal courts located in Fayette County, Kentucky for Kentucky Marina Association matters and Davidson County, Tennessee for Tennessee Marina Association matters. You consent to personal jurisdiction in those courts.


13) Changes to the Website and these Terms

We may update the Website and these Terms from time to time. Changes are effective when posted on the Website with an updated “Effective date.” Your continued use of the Website after changes become effective constitutes acceptance of the updated Terms.
